Milan, 10th March 2022 – Acciaierie d’Italia will appeal against today's ruling by the judge of the Taranto Court, Giovanni De Palma, who rejected the appeal filed by the company against the reintegration into the workplace of Mr. Riccardo Cristello.
Dr. De Palma was called to decide both in the summary phase of July 2021 and in the current appeal.
In the summary phase, the Judge had assessed the offensive nature of the expressions used by Mr. Cristello (among others, "assassins"). Furthermore, he had confirmed both the certain attributability of the post published by the employee, and the absence of retaliatory intentions by the Company, as well as the applicability of the obligation of loyalty to the employee regardless of the type of communication tools used.
The Judge had motivated the reintegration measure, assuming that the "verbal attack" by Mr. Cristello actually referred to the previous management of the Taranto steel plant, regardless of the fact that the verbal items used were conjugated to the present tense.
